Please read these Terms and Conditions carefully before using the Site. By using the Havaianas Thong Challenge Site, you are agreeing to be bound by the following terms and conditions. If you choose not to be bound by the terms and conditions, Urban Media does not grant you the right to use the Site and you must not use this Site.

Variation
Urban Media may vary these Terms and Conditions at any time. Any variations become effective on posting. By registering for the Havaianas Thong Challenge through this Site after the terms and conditions have been varied, you agree to be bound by the variation.

GENERAL TERMS & CONDITIONS FOR THE HAVAIANAS BEACH EVENT

The following conditions are applicable to both registration and participation in the event:

Participation in the event is subject to the completion of an event registration form.
If you do not complete an event registration form or you do not agree to the terms and conditions specified in the event registration form you will not be allowed to participate in the event.
Participant registration fees are non-refundable.
The event can be cancelled as a result of unsafe condition or inclement weather. A decision regarding the weather will be made in the absolute discretion of the event manager that has been appointed by Aqueo no later than 30 minutes prior to the advertised start time of the event
Aqueo reserves the right to reschedule the event, vary advertised program, prices, venues & location capacity if necessary and participant registration fees will not be refunded when any such changes are implemented
Aqueo shall in its absolute discretion be entitled to accept or reject any application to participate in the event. You may be refused permission by Aqueo to participate in the event even when you have completed an event registration form.
You may be refused permission by Aqueo to continue to participate in the event at anytime.
You agree that you will cease to participate in the event at the request of Aqueo.
Participant registration fees are inclusive of GST.
Aqueo shall not be liable for any loss or damage whatsoever suffered by a participant , including but not limited to direct or consequential loss, or personal injury suffered or sustained arising out of or in connection with the event or participation in the event.

GENERAL TERMS FOR THE Havaianas Thong Challenge Backyard Pack

By registering for a Havaianas Thong Challenge Backyard Pack, you acknowledge and agree to the following terms and conditions:

Definitions;
- "Promoter" means Aqueo Import and Distribution Pty Ltd Ltd (ABN 55 098 528 440) of 234 Bronte Road, Waverley NSW 2024 ("Aqueo")
- "Backyard Pack" means Havaianas Thong Challenge Backyard Pack
Backyard Pack is not transferable, not for re-sale, refundable or exchangeable. Backyard Pack is for private enjoyment only.
Backyard Pack must be registered and ordered before 11:59pm on January 15, 2012. Orders placed after this time will not be delivered.
Limited packs available and may sell out prior to 11:59pm on January 15, 2012.
Aqueo shall not be liable for any loss or damage whatsoever suffered by a participant , including but not limited to direct or consequential loss, or personal injury suffered or sustained arising out of or in connection with the backyard event or participation in the backyard event.
If any part of the Backyard Pack is unavailable, the Promoter, in its discretion, reserves the right to substitute the pack (or that part of the pack) with equal value and/or specification.
Promoter shall in its absolute discretion be entitled to accept or reject any application for a Backyard Pack.
Backyard Pack fees are inclusive of GST.
Free shipping to most areas of Australia, Promoter reserves the right to charge shopping costs for remote area deliveries.
Backyard Packs shipped from January 16 - January 25, 2012.

GENERAL TERMS FOR Havaianas Backyard Party Promotion

Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Promotion commences at 12.01AM on Tuesday December 13 and entries close at 11:59pm AEDST on 15th January 2012.
The judging will take place at Urban Media, Level 3, 5-13 Queen Street, Chippendale NSW 2008 on 16th January 2012. Finalists will be notified by phone on 18th January 2012.
All entry instructions and prize information published by the Promoter form part of these terms and conditions. The Promoter’s decision not to enforce a specific term or condition does not constitute a waiver of that term or condition or of the Terms and Conditions generally.
This is a game of skill and chance plays no part in determining the Finalist(s). Entries will be judged by a panel of judges appointed by the Promoter. Each entry will be individually judged based on criteria including the creativity and originality in your submission (“Selection Criteria”).
The Promoter’s decision is final and no correspondence will be entered into in respect of the Selection Criteria or any other aspect of the competition. The Promoter reserves the right not to select a winning entry for any or all of the prizes in its absolute discretion.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Winners will be notified by telephone. This is a game of skill and chance plays no part in determining the winners. The Promoter’s decision is final and no correspondence will be entered into.
The entrant judged as the winner will win “Havaianas Backyard Party" valued at $10,000.00 to only be used at privately owned venue nominated by the winner. Travel and any additional cost are not included.

If for any reason a winner does not take a prize or an element of a prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
Total prize pool value is up to “10,000”. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition.
The Promoter assumes no responsibility for:
- Any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise,
- Any theft, destruction or unauthorized access to, or alteration of such communications;
- Any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition;
- Any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise);
- Any variation in prize value to that stated in these conditions;
- Any tax liability incurred by a Finalist or you; or
- Any loss, harm or sufferance resulting from a Finalist’s use of a prize.
To the full extent permitted by law, the Promoter excludes all liability for any loss (including any damage, claim, injury, cost or expense) howsoever caused which is suffered or incurred by you or any entrant in connection with the Competition or prizes, including but not limited to:
- Any indirect, economic or consequential loss;
- Any loss arising from the negligence of the Promoter;
- Any loss arising from the negligence of the Promoter;
You must not do, or refrain from doing, any act which will harm the reputation of the Competition or the Promoter.
The Promoter reserves the right to alter these terms and conditions, withdraw any prize from the Competition or alter or cancel all or part of the Competition in its absolute discretion without notice to you.
This Competition is subject to the Promoter’s Privacy Policy and governed by the laws of all states & territories of Australia.
The promoter of the Havaianas Backyard Party promotion (“Competition”) is Aqueo Import and Distribution Pty Ltd ABN 55 098 528 440 of 234 Bronte Road, Waverley NSW 2024 (“Promoter”). Use of “Promoter” includes its related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns, and any sponsors or advertising agencies involved in the Competition.
